1. Introduction

Welcome to StickerAIArt! Our web application allows users to create unique stickers using generative AI technology. These Terms of Service ("Terms") apply to StickerAIArt. StickerAIArt allows you to generate stickers ("Creations") based on your input ("Prompts") and provided reference images ("User Content"). By accessing and using StickerAIArt, you agree to be bound by these Terms of Service and acknowledge our Privacy Policy.

2. User Registration and Subscription Plan

To access StickerAIArt’s full features, you must register for an account and subscribe to one of our plans. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3. AI Disclaimer

The AI technology used in StickerAIArt facilitates the creation of stickers based on user inputs. However, the accuracy of AI-generated content cannot be guaranteed, and we do not take responsibility for the precision or appropriateness of the content produced. It's essential to review any AI-generated content before use. A similar disclaimer will be visible within our product interface.

Creations may not be unique across users and StickerAIArt may generate the same or similar output for other users. Other users may input similar Prompts and receive the same, similar or different Creations.

4. Be a Good Human

You agree to use StickerAIArt in compliance with our Terms of Service. Misuse of the AI, including generating harmful or illegal content, may result in suspension or termination of your account.

5. AI's Role vs. Product's Role

StickerAIArt utilizes AI to assist in creating stickers, but it does not replace user judgment or serve as a standalone decision-maker. The AI component in StickerAIArt is a tool, not an advisor or a legal expert. Relying solely on the AI’s output without personal verification is not recommended.

6. Restrictions on Sharing and Publishing AI-Generated Content

You are responsible for any AI-generated content you choose to share or publish. Use of such content must adhere to our Use Policy, and you must not use AI-generated stickers in any way that infringes upon copyrights or other rights.

7. Use of Technology Partners

Our AI technology is powered in part by external technology partners. By using StickerAIArt, you consent to the sharing of your data with these partners as necessary for the functioning of the service.

8. Refund Policy

Due to the high costs associated with generating AI-created stickers, including the substantial expenses for GPU processing required to create your stickers, StickerAIArt is unable to offer refunds. Our GPU providers do not permit refunds for the processing time utilized, which in turn restricts our ability to offer refunds to our users.

By agreeing to these Terms of Service during the sign-up process, you acknowledge and consent to waive any rights to request a refund. This policy is necessary to sustain the financial viability of our services and ensure that we can continue to offer high-quality, AI-generated stickers to all our users.

9. Intellectual Property Rights

Upon creation, ownership of the AI-generated stickers, including all associated intellectual property rights, is transferred to you. This transfer grants you the unlimited right to use, distribute, and modify the stickers as you see fit. StickerAIArt and our technology partners disclaim any further rights to the stickers once created, ensuring you have full freedom to utilize the content for personal, commercial, or promotional purposes.

While ownership of the AI-generated stickers is transferred to you upon creation, by using our service you grant StickerAIArt a non-exclusive, royalty-free, worldwide license to store, use, and display the generated stickers. This license is necessary for the operation of our service, including but not limited to displaying your stickers in your account, archival purposes, and ensuring the stability and availability of our service. This right does not allow StickerAIArt to sell, redistribute, or otherwise commercialize your content without further consent from you.

10. DMCA Compliance

StickerAIArt respects the intellectual property rights of others and expects the same from our users. In accordance with the Digital Millennium Copyright Act (DMCA), we respond promptly to valid notices of copyright infringement. If you believe that your copyrighted work has been used on our site in a way that constitutes copyright infringement, please notify us by sending a DMCA notice to [email protected] with the following information:

• A description of the copyrighted work that you claim has been infringed;
• A description of where the allegedly infringing material is located on our site, providing detailed information that enables us to locate the material;

By using StickerAIArt, you may provide text prompts and reference photos (“User Content”) to generate stickers. You retain ownership of your User Content. However, by submitting it, you grant us a non-exclusive, royalty-free, worldwide, and perpetual license to use your User Content solely for the purpose of displaying the generated stickers to you during your use of our service. You represent and warrant that you have all necessary rights to grant us this license and that your User Content complies with the following guidelines:

• Does not violate any applicable law, regulation, or guideline;
• Does not infringe on the intellectual property rights of others;
• Does not contain any obscene, pornographic, or offensive material;
• Does not contain any personal information about individuals under 13 years old;
• Does not contain any harmful or malicious software.

We do not reproduce, modify, adapt, publish, or distribute your User Content. We only use it to facilitate the generation of your stickers and display them to you. We reserve the right to remove or refuse any User Content at our discretion if it does not comply with these guidelines.
